GENERAL INFORMATION 

These General Terms and Conditions of Sale govern the purchase of products from NAVONA FILMS S.R.L. (VAT and Tax Code 17847481003) made remotely on the website www.navonafilms.com, an online distribution e-commerce store. Every purchase shall be governed by the provisions of Legislative Decree 185/99 and Legislative Decree 206/05; information aimed at the conclusion of the contract shall be subject to Art. 12 of Legislative Decree 70/03 and, with regard to the protection of privacy, to the regulations set out in Legislative Decree 196/03. 

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE 

Contracts for the sale of products on the website www.santomanifesto.it are deemed concluded when the purchase order placed by the customer is received by NAVONA FILMS S.R.L. and accepted by it. By submitting their purchase order electronically, the customer declares that they have read and accepted these general terms and conditions and undertakes to observe and comply with them in their dealings with NAVONA FILMS S.R.L.. 

PROCESSING OF PERSONAL DATA 

NAVONA FILMS S.R.L.  pursuant to Art. 13 of Legislative Decree 196/2003, hereby informs that personal identification and tax data acquired, including verbally, in connection with the business relationships established, whether provided directly by the data subjects or otherwise acquired in the course of the company's activities, will be processed in compliance with the aforementioned regulations, including the confidentiality obligations they provide for. In relation to such data, the rights set out in Article 7 of Legislative Decree 196/2003 may be exercised. 

CUSTOMER OBLIGATIONS 

Before submitting their purchase order, the Customer is required to read these general terms and conditions of sale carefully. Submitting the purchase order implies full knowledge and acceptance of them. Finally, once the online purchase procedure has been completed, the Customer is required to print and keep these general terms and conditions of sale, already viewed and accepted during the conclusion of the contract. 

DEFINITION OF THE ORDER 

By submitting the order online, the Customer sends NAVONA FILMS S.R.L. an offer to purchase the product and/or products added to the cart. When the Customer places an online order for the products in their cart, they agree to purchase them at the price and on the terms set out in these General Terms and Conditions of Sale. NAVONA FILMS S.R.L. will notify the Customer of the acceptance and confirmation of the order.  In particular, NAVONA FILMS S.R.L. will not accept orders if the Customer cannot or does not wish to pay by credit card or PayPal. 

PURCHASE PROCEDURE 

The customer purchases the product, whose features are illustrated online in the relevant descriptive and technical product sheets, at the price indicated therein, plus the delivery charges specified on the website. 

Sale of used posters from the Vintage Originals Collection – “Sold as seen” clause and legal guarantee

  1. Condition of the product
    All posters sold on the website are used and supplied as is. Any signs of wear, folds or defects are described in the product sheet and visible in the photographs.

  2. Right of withdrawal
    Pursuant to Articles 52-59 of the Consumer Code (Legislative Decree 206/2005), the right of withdrawal does not apply to used goods sold as is for aesthetic or discretionary reasons, except as provided by law for goods that are defective or do not conform to the description.

  3. Legal guarantee of conformity
    The legal guarantee of conformity provided for by Articles 128-135 of the Consumer Code nonetheless remains valid. For used goods sold by a professional seller to a consumer, the duration of the guarantee may be reduced to no less than one year, as provided for by Article 130, paragraph 4, of Legislative Decree 206/2005, provided this is explicitly stated. This guarantee covers lack of conformity that makes the goods unfit for their intended use or not in accordance with the description provided.

  4. Reporting defects
    The consumer may report any lack of conformity within the time limits provided by law in order to obtain repair, replacement or a refund, as established by Articles 130 et seq. of the Consumer Code.

PAYMENT 

The customer may make the payment due by choosing one of the following methods. Payment by credit card: if the consumer wishes to pay by credit card, they may use the PayPal payment procedure, which is designed to ensure the confidentiality of the data provided by customers. For all information and further Legal Agreements, the Customer is referred to the website www.paypal.com.

DELIVERY OF PRODUCTS 

The purchased goods are delivered by courier to the address specified by the Customer when placing the online order. Any specific requirements must be communicated by the customer to  NAVONA FILMS S.R.L.. NAVONA FILMS S.R.L. guarantees delivery of the goods within 7 (seven) working days from the date of receipt of the transaction confirmation. If delivery fails because the recipient is absent at the address given in the order, the courier will leave a notice and try a second time; if the recipient is still absent, the goods will be returned to the sender. 

COMPLAINTS 

For any complaint or clarification, the customer must contact the number 3899854927 or the email address: info@navonafilms.com The customer will be contacted for clarification within 3 (three) working days of the request. Returns are accepted only where:

  • The purchased item is defective
  • The product does not match the description

Complaints and/or refund requests will not be considered if:

  • Sent via the Instagram and Facebook social channels
  • Submitted more than 14 (fourteen) days after receipt of the goods

GOVERNING LAW 

For anything not expressly provided for in this contract, the applicable Italian law shall apply.
